These Terms of Service form an agreement between you and Boost My Reviews. They apply to our website, account application, review-management platform, integrations and related products and services.

1. Agreement and eligibility

By creating an account, starting a trial, purchasing a subscription or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old and legally able to enter into this agreement. If you act for a company, partnership or other organisation, you confirm that you have authority to bind it. In these Terms, “you” includes that organisation and its authorised users.

2. The service

Boost My Reviews helps businesses collect, monitor, manage, analyse and display customer reviews. Depending on your plan, features may include review requests by email or SMS, connected review sources, widgets, reporting, AI-assisted insights or replies, QR and NFC tools, and physical review products.

During an active trial or paid subscription, we grant you a limited, non-exclusive, non-transferable and revocable right to use the service for your internal business purposes. You may allow staff and contractors to use the account on your behalf, but you remain responsible for their use.

We may improve, replace or discontinue features as our service and third-party platforms develop. Where practical, we will give reasonable notice of a material change that significantly reduces core paid functionality.

3. Accounts and security

You must provide accurate and current account, business, billing and delivery information. Keep login credentials secure, give access only to authorised users and tell us promptly if you suspect unauthorised access. You are responsible for activity carried out through your account unless it results from our failure to use reasonable care.

4. Free trial

Where offered, the free trial lasts 14 days and is intended to let a business evaluate the service. Trial features or limits may differ from a paid plan, and we may restrict repeated trials by the same person or business.

You will move to a paid subscription only when you select a paid plan and complete the required billing steps. Trial data may be deleted after the trial ends, so export anything you need before expiry.

5. Subscriptions, fees and GST

Paid subscriptions are billed in advance on the monthly or annual cycle selected at checkout and renew automatically until cancelled. Prices are in New Zealand dollars unless stated otherwise. GST treatment will be shown at checkout or on the relevant invoice.

You authorise our payment provider to charge the payment method associated with your account for subscription fees, taxes and any purchases you approve. If payment fails, we may retry the charge and suspend paid access until the amount is paid.

We may change subscription prices by giving reasonable notice. A price change will apply from your next renewal after the notice period, and you may cancel before then if you do not accept it.

6. Cancellation and refunds

You may cancel through your account where that option is available, or by contacting us. Cancel before the next renewal date to avoid the next charge. Unless we state otherwise, you may continue using paid features until the end of the period already paid for.

Subscription fees are generally non-refundable for a change of mind, partial billing period or unused account. We may agree to a refund or credit in exceptional circumstances. Nothing in these Terms limits any refund, remedy or other right that cannot lawfully be excluded under New Zealand law.

Where both you and Boost My Reviews are in trade and the services are acquired for business purposes, any contracting out of the Consumer Guarantees Act 1993 or Fair Trading Act 1986 applies only to the extent permitted by those Acts and where it is fair and reasonable to do so.

7. Physical review products

Some plans include branded or customised window or door stickers, QR review stickers, NFC and QR review cards, counter stands, or review artwork. Eligibility and quantities are those shown on the pricing page when you purchase the subscription. Production and delivery details may be confirmed separately.

  • You confirm that you have permission to use any name, logo, image, link or other material you provide for customisation.
  • You are responsible for checking and approving artwork, spelling, QR destinations and other proof details before production.
  • Small variations in colour, size, finish or positioning may occur through normal printing and manufacturing processes.
  • Delivery dates are estimates. You must provide a complete delivery address and tell us promptly about items that arrive damaged, faulty or different from the approved order.

Because personalised products cannot usually be resold, they may not be returnable for a change of mind once production has started. This does not affect any remedy available for faulty, damaged or incorrectly supplied goods.

8. Customer data, reviews and review requests

You retain ownership of business information, customer details, reviews, branding and other content you submit or connect (“Customer Content”). You grant us a limited licence to host, copy, process, transmit, format and display Customer Content only as needed to provide, secure and improve the service and meet our legal obligations.

You are responsible for the accuracy and legality of Customer Content and for having a lawful basis and any required permission to provide and use customer names, email addresses or phone numbers. When sending review requests, you must comply with the Privacy Act 2020, the Unsolicited Electronic Messages Act 2007 and applicable platform rules, including consent, sender-identification and unsubscribe requirements where they apply.

You must not create fake reviews, offer undisclosed incentives, selectively prevent dissatisfied customers from giving genuine feedback, or otherwise manipulate reviews in a misleading way. You remain responsible for reviewing and approving AI-assisted suggestions before publishing or relying on them; AI output may be incomplete or inaccurate.

9. Acceptable use

You must not use the service to:

  • break the law, infringe another person's rights, harass people or send spam;
  • upload malicious code, interfere with security, overload the service or gain unauthorised access;
  • scrape, copy, reverse engineer or probe the platform except where the law expressly permits it;
  • resell, sublicense or make the service available to third parties unless we agree in writing; or
  • publish unlawful, deceptive, defamatory, discriminatory or infringing material.

Reasonable use limits may apply to messaging, storage, integrations, AI features and support. We will contact you if usage materially exceeds what is normal for your plan.

10. Third-party integrations

The service connects with third-party review sites, messaging providers, payment services and other platforms. Their availability, data, APIs and rules are controlled by those providers and may change without notice. You are responsible for maintaining any required third-party account and complying with its terms.

We are not responsible for a third party's acts, outages, data accuracy or decision to restrict an integration. We may add, replace or remove an integration when necessary for security, reliability, compliance or because a provider changes or withdraws access.

11. Intellectual property

Boost My Reviews and its licensors own the service, software, website, designs, documentation, trademarks and other materials we provide, excluding Customer Content. These Terms do not transfer that ownership to you.

If you provide feedback or suggestions, you allow us to use them without restriction or payment, provided we do not identify you publicly without permission.

12. Availability and warranties

We will provide the service with reasonable care and skill. Internet services may sometimes be unavailable because of maintenance, faults, security events or third-party outages, and we do not promise uninterrupted or error-free access.

Results depend on factors outside our control, including your customer relationships, campaign choices and third-party platform algorithms. We do not guarantee a particular number or rating of reviews, increased sales, search ranking or business outcome.

13. Liability

Nothing in these Terms excludes liability or a right that cannot lawfully be excluded. To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential loss, loss of profit, revenue, goodwill, anticipated savings or business opportunity.

To the maximum extent permitted by law, our total liability arising from the service or these Terms is limited to the subscription fees you paid us during the 12 months immediately before the event giving rise to the claim. This limit does not apply to fraud, wilful misconduct or any other liability that the law does not allow us to limit.

You are responsible for losses or claims resulting from your unlawful Customer Content, unlawful review requests, breach of third-party platform rules or infringement of another person's rights.

14. Suspension and termination

We may suspend or terminate access where reasonably necessary to address non-payment, a material breach, unlawful activity, a serious security risk or harm to the service or another person. Where practical, we will first explain the issue and give you a reasonable opportunity to fix it.

On termination, your right to use the service ends. Provisions intended to continue—including payment obligations, intellectual property, liability and dispute terms—remain in effect. We may retain or delete data in accordance with our Privacy Policy and legal obligations.

15. Changes to these Terms

We may update these Terms to reflect changes to the service, law or business practices. We will publish the revised version with a new updated date and give reasonable notice of material changes. Continuing to use the service after the change takes effect means you accept the revised Terms; you may cancel before then if you do not agree.

16. Governing law and disputes

These Terms are governed by New Zealand law. You and Boost My Reviews submit to the non-exclusive jurisdiction of the New Zealand courts.

If a dispute arises, please contact us first with the details. Both parties will try in good faith to resolve it through direct discussion before starting formal proceedings, except where urgent relief is needed.

17. Contact
